The SVKM’S NMIMS Kirit P. Mehta School of Law hosted an insightful guest lecture on the topic, ‘Rethinking Intellectual Property Rights: Past, Present and Future,’ on the 16th February, 2024. Dr. Pratyush Nath Upetri, an esteemed Senior lecturer and LL.M Program Chair from the School of Law, Queen’s University, Belfast, Ireland joined us as the guest speaker for the event. The students of B.A.LL.B, B.B.A. LL.B and LL.M. having Intellectual Property as a specialization attended the event.
Dr. Upetri comes from the School of Law at Queen’s University in Belfast, Ireland. The university is a distinguished member of the Russell Group, and stands as a leading UK Law School with a rich history dating back to 1845. Recognized for its commitment to excellence, the school has achieved notable rankings, the most recent being 5th for Law Graduate prospects of the Complete University Guide, 2024.
Dr. Upetri is a senior lecturer and program chair for LL.M at the Law School. Prior to his current position, he held academic roles at the Faculty of Law, University of Helsinki, and the Max Planck Institute for Innovation and Competition Law, Munich. He has also been a fellow at Stanford Law School, Transatlantic Technology Law Forum (TTLF) from 2018-2023.
Dr. Upreti's expertise in international intellectual property (IP) is widely recognized. He has contributed significantly to the field, acting as an expert and undertaking commissioned studies for the United Nations Conference on Trade and Development (UNCTAD). Currently, he is a member of the expert committee on the research project of the World Health Organization (WHO) South-East Asia. He is also the author of 'Intellectual Property Objectives in International Investment Agreements' (Edward Elgar, 2022) and the Co-editor of 'Intellectual Property Rights in the Post-Pandemic World' (Edward Elgar, 2023), the latter of which was voted the IPKat 2022 IP Law Book of the Year.
With such broad experience, sir was enthusiastic to address the students. He began his lecture with an interesting dive into the development of intellectual property law. His approach towards the evolution was split in four ‘episodes.’ These episodes highlighted the major events that reshaped the understanding the world has of IP. These four episodes which started with the invention and rise of the printing press, to the current scenario of IP. Sir pointed out that when there is a disruption in the market, the State intervenes to regulate the same. He pointed out various examples of the same such as the Berne convention, the TRIPs agreement and the cases that came out of it, such as Napster.
The second part of the lecture took the second part of the lecture forward the last ‘episode’ with the current scenarios in intellectual property. This was mainly focused in relation to the emergence of Artificial Technology and its infiltration with the world of Intellectual Property. Sir pointed out the upcoming discussions in this regard such as the question whether AI can hold IP rights. This was supported by various cases being decided internationally, such as in the UK, USA and Australia. He reiterated the State intervention in case of market disruptions in IP; thus making students ponder on the need of a sui generis system for IP. The last stretch of the lecture, Dr. Upetri tickled the minds of students with the interesting innovations in AI software, which are aiding the legal process. We discussed upon the facets with which these innovations aid lawyers in with their work.
For the conclusion, sir left the students with an interesting question, ‘Whether in the modern times, IP theory needs to be altered?’ To support the same, he brought concepts such as IP as a social innovation, consumers and their right to repair and finally, IP rights without the base of innovation.
In conclusion, Dr. Upetri's guest lecture provided an insightful glimpse into the exciting changes in modern IP, offering students a deeper understanding of its principles, challenges, and potential applications. The lecture served as a catalyst for further exploration and research in the field of IP.
